LIABILITY NOTICE

As with anything, there is always the "fine print", but we make it noticeably a part of our Navigation so it is not hidden from anyone.  Any prospective customer is hereby made aware of their waiver of liability toward Fox Horse Design, its owner(s), employees, representatives, associates, heirs, and assigns.

Upon engaging Fox Horse Design to create your web site, you agree to protect and indemnify Fox Horse Design, it's owners, employees, representatives, associates, heirs, and assigns against all liabilities, loss or expenses including any consulting or attorney's fees including any and all court costs or arbitration costs arising from claims for libel, unfair infringement of trademarks/names/patents, unfair competition, all unfair trade practices, violation of privacy, infringement of copy writes, and proprietary rights consulting from publishing, creation and management of a web site.

Fox Horse Design is not liable for loss caused by failure of a web server, web host, nor software to secure the site on line.  Periodic off-line time can occasionally be expected due to web server or web host maintenance; and, software programs are often updated which may cause delays.  Fox Horse Design will take every measure to re-establish on line status when necessary.

Fox Horse Design is not liable nor to be held accountable nor liable for copy write infringement nor resulting damages on the part of site owner.  At their own expense, every site owner with valuable photographs or text is advised to seek copy write protection for their photographic and intellectual property. 

Fox Horse Design will not be held liable for any infringement nor liability caused by Customer upon anyone else's photographic or intellectual property.  Fox Horse Design reserves the right to refuse use of any questionable, abusive, undesirable or illegal content.

Fox Horse Design will not be held liable by web site owner nor their representatives, heirs or assigns for any omissions or errors within the content, updating or programming by Fox Horse Design.  Any necessary correction for omission or error will be at the normal charge for maintenance.  Additionally, Fox Horse Design, its owners, employees, representatives, associates, heirs and assigns will not be held liable for any loss of sale, business interest nor any other loss.

Should a customer decide to abandon their project with Fox Horse Design prior to turning the project over to customer, all costs due and payable at that time will be paid to Fox Horse Design by Customer prior to Fox Horse Design providing access to site.  If new charges are incurred by Fox Horse Design for domain/hosting transfer, those costs will also be paid by Customer prior to completion of transfer.

Fox Horse Design reserves the right to take Customer's site off line until any bill due and owing is paid in full.

In the event Fox Horse Design is responsible for payment(s) to Host Provider and/or Domain name provider, Fox Horse Design reserves the right to cancel at any time due to non-payment, unethical business practices, or any issue which cannot be resolved between Fox Horse Design and Customer(s).
